GENERAL CONDITIONS OF ALPIN EOOD FOR PROVIDING A SERVICE SKI SCHOOL AND RENTAL SKI EQUIPMENT
І. GENERAL RULES
1.1. The customers of the ski school and ski wardrobes are entitled before run the courses from the ski school and receipt of sports equipment to be informed about the requirements concerning the type of equipment which is necessary, and concerning the content of the courses in which they will participate.
1.2. The clients are obliged to inform the personnel in the ski wardrobes for their physical data in order to be equipped with the appropriate set of equipment, and to inform the ski instructors at the ski school for level of proficiency of the relevant winter sport with a view to be included in appropriate to their level specialized courses.
1.3. Ski school ensures and is responsible, that the service provided practical training in the various winter sports will be performed by ski instructors, possessing the required practical training, professional qualification and competence, in accordance with the provisions of the effective Bulgarian legislation.
1.4. The customers are responsible for the status and effectiveness of their personal equipment when they participate in courses at the ski school on training in winter sports.
1.5 The ski school has the right to terminate the participation of clients in training courses in the various winter sports when the personnel found that their equipment is inappropriate or in unsatisfactory condition and/or if the declared of them level of knowledge of the respective winter sport does not comply with the level of the appropriate course and/or if customers do not respect with instructions and recommendations of the ski instructors in order to ensure the safety of customers, in their participation in relevant courses.
1.6. Clients participate in courses conducted by the ski school at their own risk. Ski instructors at the ski schools possess professional liability insurance, according to the Bulgarian legislation, which compensate customers in the event of damage occurring, as a result of proven wrongful act or omission of ski instructors.
1.7. The ski school is not responsible and has no obligation to provide insurances to compensate customers and/or third parties in accidents caused willingly or unwillingly by the customer himself.
1.8. Providing the service ski school - training of clients in the various winter sports, shall be based on concluded in writing form or electronically (by request and confirmation) individual or collective contracts with the ski school.
1.9. The customers are obliged to appear at the agreed time and place agreed for run the courses from the ski school on the education in the relevant winter sports, with the required equipment. In case of delay, missing the customer, and in the absence of the required equipment, according to preliminary instructions, the ski school not due to pay any compensation to the customer.
1.10. The customers are obliged when participating in training courses in the various winter sports to comply with the instructions and recommendations of ski instructors to follow the rules to safe behavior in the ski area of resort complex Borovets and to comply with the marking of the ski slopes.
1.11. In the event that ski school cannot provide the service at the agreed time with customers and/or to terminate of the provision of the service before the agreed time for reasons, for which the ski school does not meet such as: accidents, power outages, closure of the ski area due to adverse weather conditions such as heavy snow, lack of snow, very low or very high temperatures, fog, hurricane winds, torrential rain and other circumstances that cannot be provided when purchasing the service, the ski school does not owe cash benefits, but can compensate the customers pursuant to the additional agreement.
1.12. Ski wardrobes are responsible and ensure that the sports equipment, that is rented out, is in a good technical and operating condition, that the personnel have the required professional qualification and experience to perform the required settings of equipment, according to the declared from the customers physical data and in accordance with the requirements and the specific instructions of the manufacturer of the respective trademark equipment.
1.13. Ski wardrobes are not responsible for damages that are not direct and immediate consequence of the wrongful act or omission of their staff, and are caused by factors and events, that are beyond their control.
1.14. The staff of the ski wardrobes at giving sports equipment rental perform the following activities:
1.14.1. Provides customers with equipment corresponding to the declared by them physical data: height (in centimeters), weight (in kilograms), number of shoes (according to EU numbering).
1.14.2. Sets the machines according to declared by customers physical data and level of proficiency in the appropriate winter sport and in accordance with the technical requirements and the specific instructions of the manufacturer of the relevant brand sports equipment, which is rented out.
1.15. Providing the service renting sports equipment, are based on the concluded in writing form or electronically (by request and confirmation) individual or group contracts.
ІІ. RESPONSIBILITY OF THE CUSTOMERS AND PERSONNEL ON SKI WARDROBES IN PROVIDING OF SPORTS EQUIPMENT FOR RENT
2.1. The clients are required to provide the personnel of the ski wardrobes correct and true information on their physical descriptions (height in centimeters, weight in kilograms and number of shoes according to EU numbering as well as on) the level of proficiency of the respective winter sport, in order to be equipped with the appropriate equipment set and in respect of the correct setup of the machines.
2.2. After signing the contract for provision of sports equipment rental, the customer acquires a personal right to use the equipment provided on the ski slopes that are open and ready for use. The customer has the right to provide third parties his equipment and use it outside the ski area of resort complex Borovets.
2.3. The customers are obliged to serve with the provided sports equipment properly, so as to avoid its damage or loss.
2.4. Customers are not entitled to make changes to the setup of the equipment carried out by the personnel of the ski wardrobe. If there is need further adjustment, the customer is obliged to ask the personnel of the ski wardrobe to perform additional setup. Any additional setup of equipment should be reflected in the contract for rental.
2.5. On the equipment leased, the customers do not have to leave any marks, and no part of it should be removed or loosened.
2.6. In the event that rented equipment is damaged and needs repair, the customer is obliged to return it in the ski wardrobe, from which he received, to be corrected.
2.7. Return of leased equipment from customers should be done daily, regardless of the number of days for which is sought, unless the contract provides otherwise.
2.8. If the customer wishes to extend the period in which he will use the equipment, it should be done before the expiry of the rent period, specified in the contract.
2.9. If the customer returns the equipment after the period specified in the contract has already expired, ski wardrobe has the right to require the customer to pay for the time during which the equipment has been used, based on the price specified in the price list of ski wardrobe for the shortest period for rental of sports equipment.
2.10. The personnel in the ski wardrobe is responsible for proper setup of equipment, based on the provided by the customer individual information and in accordance with the requirements and specific instructions of the relevant manufacturer of the equipment.
III. DAMAGE OR LOSS OF RENTED OUT SPORTS EQUIPMENT
3.1. The customer is obliged to notify immediately the personnel of ski wardrobes for each incident, associated with the damage and/or loss of leased equipment.
3.2. The customer is obliged to inform the police in case of theft of leased sports equipment.
ІV. RESPONSIBILITY OF THE CUSTOMERS IN DAMAGE OR LOSS OF RENTED OUT SPORTS EQUIPMENT
4.1. The customer is obliged to pay to the ski wardrobe compensation in case of loss and/or damage to the granted rent sports equipment.
4.2. The personnel of the ski wardrobes is obliged to inform the customer of any damage noticed upon return of the equipment.
4.3. The customer is obliged to pay compensation to the ski wardrobe for loss/damage to equipment in the manner specified below:
4.3.1. In loss of equipment, the compensation amount to the value of the lost equipment at market prices for the relevant equipment at the time of payment of compensation;
4.3.2. In damage to the equipment, which can be corrected by the personnel of the ski wardrobe - at prices fixed in the price list of the ski workshop in ski wardrobe;
4.3.3. When damage to the equipment, which cannot be corrected by the personnel of the ski wardrobe, compensation amounting to the value of the damaged equipment at market prices for the relevant equipment at the time of payment of compensation.
4.4. The customer does not owe to ski wardrobe payment of compensation for normal wear/tear on equipment, resulting from its ordinary use.
V. PAYMENT FOR THE SERVICES
5.1. When renting sports equipment and/or use of the service ski school on site in the resort complex Borovets, the services are payable upon signing of the contract between the parties, at prices fixed in the price list for the relevant service.
5.2. Upon preliminary request for use of the service providing sports equipment rental and/or ski school on the internet, the payment is done in confirming the application.
5.3. Upon preliminary request for use of the service providing sports equipment rental and/or ski school, made through a tour operator, the payment is done in the conditions of the contract with the tour operator for the delivery of additional services.
VІ. CANCELLATION AND EARLY TERMINATION OF SERVICES PROVIDED
6.1. The customers are responsible for their appearance at the agreed time and place agreed for the providing of agreed.
